Terms of Service
At Qixtech, we strive for clarity and mutual understanding in our partnerships. This rerms of service is straightforward, avoiding complex legal jargon, to ensure both parties feel comfortable and protected.
Mutual Commitments
As our client, you agree to provide necessary materials including text, images, and other information in a timely manner and adhere to set deadlines and payment schedules. Qixtech has the experience and ability to perform the services you need, and we will carry them out in a professional and timely manner. We will endeavor to meet all set deadlines. However, we cannot be responsible for missed launch dates or deadlines if there are delays in your supply of materials, or if our work is not approved or signed off on time. We will maintain the confidentiality of any information you provide us.
Design and Development
If we are tasked with designing your application, we will create designs that encompass the look, feel, layout, and functionality of your website. This contract includes one primary design and allows up to two rounds of revisions. Should you be unsatisfied with the designs at this stage, you are required to pay in full for all work completed up to that point. You then have the option to either cancel the contract or continue to engage us for additional design revisions at our standard rates.
HTML and CSS Layout Templates
If the project involves HTML markup and CSS templates, we will develop these using valid HTML and CSS code. Given the ever-changing landscape of web browsers and devices, our focus is on adopting a forward-looking approach. Therefore, we will test our markup and CSS on the latest versions of all major desktop browsers to maximize their effectiveness. Users with older or less advanced browsers or devices will receive a design tailored to their software’s capabilities. Please note, we do not support Microsoft Internet Explorer 6, as its behavior is unpredictable.
Additionally, we will ensure these templates function well on Apple’s iPad. We do not typically test on outdated or discontinued browsers, such as Microsoft Internet Explorer 6 or 5.5 for Windows or Mac, or earlier versions of Apple’s Safari, Mozilla Firefox, or Opera, unless specifically requested. Should you require support for these older browsers, additional charges will apply at our standard rate for any extra design, development, and testing work needed.

Although we may have authored numerous blog posts, we are not responsible for writing or inputting text copy unless explicitly included in the original estimate. However, we are more than willing to assist with these tasks. Should you require our help, additional charges at our standard copywriting or content input rate will apply, beyond the initial estimate. It is your responsibility to ensure that all content on your website complies with copyright laws and regulations.
Photographs
You will supply us with photographs in digital format. If you choose to buy stock photographs, we can suggest vendors of stock photography. Any time we spend searching for appropriate photographs will be charged at our standard discovery rate.
Changes and Revisions
Our extensive experience has shown that fixed-price contracts can often be restrictive, potentially limiting your initial ideas and inhibiting flexibility in making changes. We aim to provide you with the freedom to refine your vision as the project evolves.
The estimated prices outlined in this document are based on our assessment of the work required to achieve your specified goals. Should you decide to alter your plans, such as adding extra pages, templates, or new functionalities, we can certainly accommodate these changes. However, please note that such adjustments will incur additional charges. These will need to be agreed upon before we proceed with the extra work, which may also lead to revised deadlines. We believe in maintaining transparency throughout this process to ensure we are aligned in our understanding and approach.
We may request that change requests be submitted in writing to maintain accurate records. Significantly altering the nature or functions of the project may lead to reevaluation and possible cancellation of the current project. In such cases, you will be responsible for full payment of the work completed to date. Subsequent work based on new requirements will necessitate a fresh quote and contract.
All services provided by third-party integrated into the client product, it is the client’s responsibility to bear the costs for such services, such as Google Map Services.
Technical Support
You might already possess professional website hosting and possibly even handle it in-house – if so, that’s excellent. However, if you don’t manage your own website hosting, or if your current hosting solution is incompatible with the services we’re providing, we’re prepared to establish an account for you on our servers. It’s important to note that our technical support extends exclusively to hosting, email, and related services on our own servers, and does not cover any external hosting environments.
Legal and Liability
We cannot guarantee that the functions within web page templates or a completed website will always be error-free. Therefore, we are not liable for any damages, including lost profits, savings, or other incidental, consequential, or special damages arising from operating or failing to operate this website and any other web pages. This applies even if we have been informed of the possibility of such damages.
Should any provision of this agreement be found unlawful, void, or for any reason unenforceable, that provision shall be considered severable from this agreement. However, this will not affect the validity and enforceability of any remaining provisions.
Copyrights
You assure us that all text, graphics, photos, designs, trademarks, and other artworks provided by you for inclusion on the website are either your property or you have secured the necessary permissions for their use. Upon receiving your final payment, copyright assignments are as follows:
The graphics and other visual elements we create for this project will be your property.
We will provide you with a copy of all files, which should be securely stored, as we are not obliged to retain them or supply the original source files used in their creation.
You retain ownership of the text content, photographs, and other data you provide unless they are owned by others. We retain ownership of the markup, CSS, and other code, licensing it to you solely for use in this project. We reserve the right to showcase the completed project in our portfolio and discuss it in various media, including websites, magazine articles, and books about web design.
Note: Inability to provide all the necessary content at this stage does not imply a failure in our services. Once the site is tested and ready for launch, either with your content or placeholder images and text, we will issue the final invoice. Following payment, we will hand over control and guide you on how to add or modify content. If the final invoice is not settled within the stipulated credit terms, we are not obligated to maintain the site on our testing server or continue the project.
